Terms of Service

These Terms of Service ("Terms") govern your use of the Nexus web application (the "App") operated by SoilSafe Ltd. ("SoilSafe," "we," "us," or "our"). By accessing the App, you agree to these Terms.

1. Access and Account Security

  • Access is granted based on your business relationship with SoilSafe or one of our clients.
  • You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account or password with any third party.
  • You are solely responsible for all activity occurring under your account.

2. Data Submission and Accuracy

  • You represent that all information you submit to the App (including names of personnel and project details) is accurate and up to date.
  • All data submitted to the App becomes the property of either SoilSafe or the relevant Client, subject to the specific commercial agreement governing the project. As an individual user, you claim no ownership over data entered into the platform.

3. Confidentiality

  • Any data, reports, or project information you view or download from the App is strictly confidential.
  • You may only use this information for the specific business purposes for which you were granted access. You may not disclose this data to third parties unless expressly agreed upon in writing by SoilSafe or the relevant Client.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle your personal data, such as your email address and system logs.

5. Termination and Modification

  • Unless otherwise agreed in a separate written contract, SoilSafe reserves the right to suspend or terminate your access to the App, or modify/remove any part of the service, at its sole discretion and without prior notice.
  • Upon termination, your right to use the App ceases immediately, but your obligations regarding confidentiality and data ownership remain in effect.

6. Disclaimers and Limitation of Liability

  • The App is provided on an "as is" and "as available" basis. SoilSafe makes no warranties, express or implied, regarding the App's uptime or fitness for a particular purpose.
  • To the maximum extent permitted by law, SoilSafe shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
